  1. Why do we have this privacy policy and who are we?

This Data Protection Privacy Policy is intended to inform you about the processing of your personal data by the International Aerospace Quality Group, to set out your rights and to answer any queries you may have about your personal data.

In the context of this policy, the term ‘"you" is the individual or "data subject" whose personal data the International Aerospace Quality Group (IAQG) is processing and not the organization you may be representing.

By "we" or "IAQG" we mean the International Aerospace Quality Group, a legally incorporated not for profit association that sets the standard for quality within the worldwide supply chain of the aerospace industry and with memberships from America, Europe and Asia Pacific regions.

The IAQG, Association Internationale Sans But Lucratif, is headquartered at Boulevard Auguste Reyers 80 Bruxelles,1030 BELGIUM, and registered at the crossroad bank of enterprises under number 543.909.583.

The IAQG is acting as the controller where you are a representative of an IAQG Member Company, Committee Member, Online Aerospace Supplier Information System (OASIS) participant/user, Supply Chain Management Handbook (SCMH) user or IAQG Contractor.

The IAQG personal information handling policy and procedures have been developed in line with the requirements of the Regulation EU 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation or "GDPR").

  1. What personal data do IAQG collect about me?

We collect and process personal data of a professional nature by means of cookies or by means of your contact with us or the contact with your organization with us, when (a) your member company contacts us to add you as its representative in the IAQG or as a committee participant; (b) you register to access and utilize IAQG data and information (such as OASIS or SCMH); (c) you attend IAQG or sector meetings and/or (d) you or your organization are contractors with the IAQG.

The personal data we collect are the following:

  • Your professional contact details (first name and last name, work address, postcode, email address and /or phone number, geographical region or country);
  • Your function/title and key competences;
  • Your committees of activity or meeting attendance;
  • Photography in association with IAQG meetings and activities;
  • Your contractor terms/financials;
  • Your questions/comments/communications;
  • Any data you send us if we communicate with you, including by e-mail;
  • The personal data you choose to provide to IAQG in order to get a better experience.

· Why do IAQG process my personal data, what are the legitimates basis for the processing of my personal data and what are the storage periods?

The personal data you provide to IAQG may be processed for the purposes listed below and on the legal basis indicated.

IAQG ensures that the processing of your personal data is organized in a lawful manner in accordance with article 6 of the GDPR.

Your personal data are stored for as long as is necessary to achieve the purposes for which they were collected and, in any case, until the expiry of the legal retention periods, in particular for tax and accounting purposes and until the end of the limitation period for contractual liability.

Your personal data will be deleted when:

  • they are no long necessary for the purpose for which they were collected; or
  • you have validly exercised you right to erasure; or
  • you have withdrawn your consent, when the processing is based on the consent as legal basis.

Below, we detail some of the specific legitimate basis and the storage periods of personal data in relation to those legitimate basis.

These processing operations are based on the legitimate interests of the IAQG and of its member organizations in the functioning of the IAQG in accordance with its corporate objectives as a standard writing and networking organization. Considering that your personal data are professional information, we consider that this processing has limited impact on your rights and interest.

When you act as an IAQG contractor, the processing of your personal data is necessary for the performance of a contract to which you are a party including the organization of your work with us and to meet our contractual obligations (e.g., pay invoices).

·   Direct marketing

We process your personal data to offer you a full experience with IAQG, which includes among others:

  • sending newsletters;
  • business communication;
  • business recognitions

The legal basis of this processing is your consent.

The data processed in this context are kept as long as your consent is not withdrawn; this consent will be refreshed periodically.

  1. Managing the contractual relationship and all that it entails, including

We process your personal data in the context of pre-contractual and contractual relations, which includes among others:

  • responding to your requests for pre-contractual measures (e.g., request for information);
  • performing concluded contracts with you;
  • communicating with regard to requests for pre-contractual measures or concluded contracts;
  • managing the billing.

For example:

  • IAQG’s organization, including committees, organization of networking between member organizations;
  • organization of events and activities which includes the administration of members and attendees;
  • dietary preferences or special needs (in association with IAQG meetings and conferences).

This processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into the contract.

The data processed in this context are kept for the duration of the pre-contractual and/or contractual relationship and until the end of the period of prescription of the obligations related to the contract or the precontractual phase.

  1. Securing and enhancing your use of our website, including

We process your personal data for (i) compiling statistic related to patterns and trends of browsing on IAQG website and (ii) implementing security.

The legal basis of these processing is the legitimate interests pursued by the IAQG to collect personal data necessary for analytical purposes to improve the user’s experience and the IAQG website and necessary to ensure the security of its website to protect your information from unauthorized access, loss, destruction or alteration of your personal data.

The data processed in this context are kept for 1 year following their collection.

Please note that the regulations in force may require IAQG to process your personal navigation data, in particular for survey purposes, and for longer periods than those indicated in the third paragraph.

  1. Managing your enquiries

The processing of your personal data allows us to manage any enquiries you may need to communicate to us.

It is the legitimate interest of IAQG to be able to answer to enquiries you may have in order to give you the relevant information.

The data processed in this context are kept 1 year following their collection.

  1. Managing your complaints

The processing of your data in the event of a complaint may be necessary for the performance of a contract to which you are a party or may be necessary for the performance of pre-contractual measures taken at your request.

The data are kept for the duration of the pre-contractual and/or contractual relationship and until the end of the period of prescription of the obligations related to the contract or the precontractual phase.

Apart from the two cases mentioned above, the processing of your data in the event of a complaint is based on the legitimate interests of IAQG, which consist of being able to give the best possible follow-up to your complaint and to prevent its recurrence. This may include taking appropriate action against those within IAQG who may have made a mistake, improving internal procedures and generally improving its service. However, you may object to the processing of your data on this basis if your interests or fundamental rights and freedoms prevail over the said legitimate interests of IAQG.

The data used for the purposes mentioned in the previous paragraph are kept for a period of 18 months from the last contact with you.

  1. Protecting our rights in justice

IAQG may need to process your personal data in order to enforce or defend its rights in court or in the context of a mediation.

It is the legitimate interest of IAQG to be able to defend itself in justice, especially in front of courts or in the context of a mediation.

The data processed in this context are kept for the time necessary to bring the dispute to its final conclusion and in compliance with legal obligations, in particular with regard to archiving and accounting, which may prescribe a longer period for all or part of the data kept.

  1. Taking into account your rights to the protection of your personal data

As described in detail below (see "What are my rights in relation to my personal data?"), the protection of your personal data is an important value for IAQG. We therefore also process your data to enable you to exercise your rights towards us and to protect your personal data.

This consideration and protection is a legal obligation, based in particular on the GDPR.

This processing, consubstantial of the purposes listed above, ceases at the same time as them.

  1. Ensuring compliance with applicable legislations

The processing of the personal data you provide to IAQG can be necessary for compliance with a legal obligation to which IAQG is subject, such as for tax reasons or in order to comply with accounting norms.

  1. With whom and where will IAQG share my personal data?

We may share your personal data with member organizations and committees to process it for the purposes of inter-group administration.

We may also share your personal data with our subcontractors which will act as processors, i.e. third-party providers of services on behalf of the IAQG, including web hosting, communication, business development, finance processing and accounting.

Where necessary for these purposes, IAQG may also disclose your data to the following third parties:

  • banking institutions;
  • tax and social security authorities;
  • our lawyers in the event of litigation;
  • criminal and judicial authorities;
  • statutory auditors.

Any transfer of personal data to a third party inside the EU/EEA will only take place if the recipient is compliant with European privacy and personal data protection regulations.

Some of our processors are established outside the EEA, meaning that your personal data will be transferred to a third country. Those processors may be located in a country covered by an adequacy decision by the European Commission and if this is not the case, the protection of your data is safeguarded by means of the standard contract clauses (Commission implementing decision 2021/914) or similar constructions such as binding corporate rules. · What are my rights in relation to my personal data?

You have, under the conditions defined by the applicable regulations, and in particular the chapter 3 of GDPR:

    1. the right to withdraw at any time your consent to the parts of the processing carried out by IAQG based on said consent;
    2. the right to obtain from IAQG confirmation as to whether or not personal data relating to you are being processed and, when they are, access to such personal data as well as to various information on the processing operations (purposes of the processing, categories of personal data concerned, recipients or categories of recipients to whom the personal data have been or will be disclosed, the intended storage period of the personal data or, when this is not possible, the criteria used to determine such period, etc.);
    3. the right to obtain from IAQG, as soon as possible, the rectification of your personal data that are inaccurate;
    4. the right to obtain from IAQG the deletion, as soon as possible, of your personal data;
    5. the right to obtain from IAQG the limitation of the processing;
    6. the right to receive your personal data provided to IAQG in a structured, commonly used and machine-readable format and the right to transfer such data to another controller without IAQG's hindrance;
    7. the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you in a similar manner.

You also have:

    1. the right to obtain from IAQG at any time, on grounds relating to your particular situation, that it no longer processes your personal data where such processing, including profiling, is based on its legitimate interests;
    2. the right to object at any time to processing of your personal data for the purpose of direct marketing, including profiling to the extent that it is related to such marketing.

In the event of manifestly unfounded or excessive requests, in particular because of their repetitive character, IAQG may either :

  • charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested; or
  • refuse to act on the request.

IAQG shall bear the burden of demonstrating the manifestly unfounded or excessive character of the request.

  1. Right of complaint to the data protection authority

You may also contact the competent Data Protection Authority if you consider that the processing of your personal data by IAQG is not compliant with data protection rules.
